Contract T&A
This agreement contains the entire understanding between 2K Photography and the Client. It supersedes all prior and simultaneous agreements between the parties. The only way to change or add to this agreement is to do so in writing, and providing the document is signed by all the relevant parties. It is understood that even with the signing of a contract and/or verbal agreement, no day is reserved without a deposit.
Pre-Wedding Consultation: We should plan a time to discuss well before the wedding. Clients can outline their expectations and 2K Photography can advise on planning, logistics and timings where needed. If required, the Clients are welcome to check in for an additional chat whenever they see fit to discuss any changes, especially if plans change.
Retainer: A non-refundable retainer fee of 30% of the cost of the chosen package is required to hold the date of your wedding. No date is reserved until a retainer is received. The balance of the complete package price must be paid a week before the date of the wedding. If final payment is not received as set forth herein, the 2K Photography reserves the right to withhold delivery of the images and or not attend the wedding until payment is received. Upon Client’s signature and payment of retainer fee, 2K Photography agrees to reserve the date and time specified. The retainer fee is applied towards the final contracted wedding package and is not in addition to the package chosen. Once the contract is signed the retainer must be provided within 3 days, if the retainer is not received within 3 days of the signing of the contract, the contract is null and void, and your date released for other couples to book.
Cooperation: The Clients and the Photographers consent to happily cooperating and communicating with each other to achieve the best possible result within the understanding of this contract. We recommend that 2K Photography be provided with a helper (usually the wedding planner, best man, or maid of honor) who will help point out key individuals to be photographed. The Photographers may also require the assistance of the helper in organizing family groups. The Clients or Helper also agree to give the Photographers sufficient warning of key events at the wedding to give the Photographers time to prepare e.g. Bouquet throwing, cutting the cake, speeches etc. Please note that not all guests like having their photo taken. In such cases the Photographer will use his discretion but cannot be held responsible for a lack of photos of these people.
Turn Around Time: Clients can expect edited photos to be complete and full online gallery available for download between 6-8 weeks after the wedding date. We will not give out all of the raw images taken from the day. For one, they are in a format only read by editing software. Secondly, we believe in handing over the best work possible and use our best judgment to do so. You will receive approximately 600 delivered images. The client agrees 2K Photography’s expertise and judgment when picking the edited photos to be delivered. Every wedding is unique, but believe we will do our best to capture every critical moment.
The Schedule: An itinerary of the wedding day must be given to the photographers prior to the wedding day. Our shooting schedule, style of work and experience are designed to achieve a great set of wedding photos for the Clients first and foremost. Both the Clients and 2K Photography therefore agree that punctuality and cheerful cooperation are essential to producing outstanding results, and will work together in order to create the best timeline for photos. In cases where the wedding does not run on time, we cannot guarantee to always follow what was originally planned due to lack of time, although in such circumstances we will do our absolute best to accommodate, improvise and get the job done as expected.
Travel Expenses: If travel is required for the Photographer, the Client is responsible for all travel, lodging accommodations, and transportation expenses. Destination weddings requiring air travel, and weddings 30 miles outside of Houston incur extra cost which will be invoiced separately. 2K Photography will find appropriately priced flights and lodging to keep cost within reason. Travel expenses will be included as an item on the invoice and must be paid in a timely manner to ensure all appointments can be booked 3 months prior to the wedding day.
Change of Date or Venue: Photographers must be notified immediately of any changes in schedule or location, at least one week prior to the scheduled date of event. Notification of any changes can be made by phone, text, or written notice sent via email for documentation. It is the Client’s responsibility to confirm all arrangements at least 7-10 days prior to the event. In the event of change of address or contact information (time, etc.) as listed, you must notify 2K Photography. Changing your date is subject to the availability of that date.
Exclusivity: The Photographers shall be the exclusive professional photographer retained by the Client for the purpose of photographing the wedding day. All of your guests will have phones or cameras of their own, and will want to photograph the Clients. In the spirit of cheerful cooperation the Clients agree to give the Photographers precedence over the guests in order to take the photographs required for the wedding services described above. We cannot be held liable for a lack of wedding photos if guests taking their own photos of the Clients continually interrupt the Photographer's work. Once we get the shots needed for you, guest are free to use their cameras/phones. This just makes sure we don’t miss anything.
House Rules: The Photographers are sometimes limited by rules imposed by ministers and venue management as to what can and cannot be done. For example, some ministers insist that no flash photography is allowed, and others will insist that the Photographer(s) shoot from a specific location and not walk up the aisle or stand at the altar. In such circumstances, the Clients agree to accept the technical limitations that may be imposed on the equipment used. We advise the Clients to make themselves aware of the rules of the venue chosen and if necessary negotiate with the personnel concerned. We will also due are part to find out these rules and follow accordingly.
Cancellation: In the event that the Client cancels prior to the wedding day, all monies paid to the photographer shall be forfeited by the Client. Unless such cancellation is caused by an unforeseen medical emergency, then monies paid, excluding travel expenses, shall be reimbursed by the Photographer. If the wedding is cancelled on the date of the wedding, the Client is liable to pay the total balance owed.
Copyright Law: The copyright of photographs remains with 2K Photographer. The images taken by the Photographer are for personal use by the Clients, friends, and relatives. Sale, publication or any commercial use of the photographs is not allowed without prior written permission from the Photographer. Clients have printing rights to all images.
Model Release: The Clients grants 2K Photography consent to use the photographs of the Clients for editorial, competition, advertising, to alter/edit the photographs without restriction; and to copyright the images.
Limit of Liability: If the Photographer is too ill or becomes injured and cannot supply the wedding services as promised, the 2K Photography will book a replacement wedding photographer for the Clients. If the second photographer has been booked, and the primary photographer is ill, the second photographer will be the sole photographer for the day. If both photographers are unavailable and a replacement photographer cannot be found then liability is limited to a refund of any payments received. We have working methods in place to prevent loss or damage to your images. However, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons in or beyond our control. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied.
